Zwingende Regelung

Im Verbund mit der Scheidung ist nach dem Gesetz zwingend auch der Versorgungsausgleich zu regeln. Grundlage ist das Versorgungsausgleichsgesetz (VersAusglG).

Prüfungsobliegenheiten des Familiengerichts

Das Gericht prüft, welche Anwartschaften auf Altersversorgung während der Ehe ( denn nur solche werden einbezogen) von den Ehegatten erworben wurden. Dies betrifft insbesondere Anwartschaften in der Deutschen Rentenversicherung und in berufsständischen Versorgungseinrichtungen, aber auch der betrieblichen und privaten Altersvorsoge. Die jeweiligen Anwartschaften sind dem anderen Ehegatten hälftig auszugleichen.

Ausnahmen u.a. bei kurzer Ehedauer

Eine Ausnahme besteht bei einer Ehedauer bis zu 3 Jahren. In diesem Fall wird der Versorgungsausgleich nur auf Antrag eines Ehegatten durchgeführt. Gestaltungsmöglichkeiten und Einschränkungen bestehen auch, wenn die Durchführung des Versorgungsausgleichs unbillig wäre oder die Ehegatten wirksam (notariell beurkundet) eine abweichende Vereinbarung getroffen haben, die jedoch der Billigung des Familiengerichts unterliegt.
